Terms of Service

These Terms of Service apply to the use of the TuliTuikku online store and to purchases made through the store.

By placing an order with TuliTuikku, you agree to these Terms of Service together with our Privacy Policy, Delivery Policy and Return and Cancellation Policy.

Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection law.

2. Online Store

TuliTuikku sells handmade products, including candles, jewellery and other handmade goods.

Our online store is hosted by Shopify, which provides the technical e-commerce platform that allows us to offer our products to customers.

Purchases made through the TuliTuikku online store are contracts between the customer and TuliTuikku. Shopify is not the seller of TuliTuikku products.

3. Products and Handmade Variations

We aim to describe and photograph our products as accurately as reasonably possible.

Because many TuliTuikku products are handmade, individual products may have small variations in colour, shape, pattern, placement of decorative elements or other details. Such minor variations are a natural characteristic of handmade products and do not necessarily constitute a defect.

Colours may also appear slightly different depending on the customer's screen and device settings.

Product descriptions, images, dimensions and other information are provided to help customers make an informed purchasing decision.

4. Product Safety

Products must be used in accordance with the safety information, warnings and instructions supplied with the product or displayed on the product or its packaging.

Candles must always be used in accordance with the provided candle safety instructions and warnings.

Customers should discontinue use of a product if it appears damaged or unsafe and contact TuliTuikku if they believe the product may be defective or present a safety issue.

Nothing in this section limits TuliTuikku's responsibility for product safety or any statutory rights available to consumers.

5. Orders

When you place an order, you are submitting an offer to purchase the products included in your order.

After placing an order, you will receive an electronic confirmation using the contact information provided during checkout.

TuliTuikku may refuse or cancel an order where there is a legitimate reason to do so, for example if:

a product is unexpectedly unavailable;
there is an obvious pricing or technical error;
payment cannot be completed;
the information required to fulfil the order is incomplete or clearly incorrect; or
fulfilling the order would violate applicable law.

If an order that has already been paid for is cancelled by TuliTuikku, the relevant payment will be refunded.

6. Prices

Product prices are displayed in the online store before an order is placed.

Where applicable, prices shown to consumers include VAT in accordance with applicable tax rules.

Shipping charges and any other applicable charges will be shown to the customer before the order is completed.

The total amount payable will be displayed at checkout before the customer confirms the purchase.

TuliTuikku reserves the right to change prices for future orders. Price changes do not affect orders that have already been concluded.

Obvious pricing errors may be corrected in accordance with applicable law.

7. Payment

Available payment methods are displayed during checkout.

Payments may be processed by third-party payment service providers available through the TuliTuikku online store.

The customer is responsible for providing accurate payment and billing information.

TuliTuikku does not generally receive or store the customer's complete payment card details.

8. Shipping and Delivery

TuliTuikku currently delivers orders to the destinations made available at checkout.

Available shipping methods, shipping charges and estimated delivery information are displayed during checkout or described in our Delivery Policy.

Orders are shipped to the delivery information provided by the customer. Customers are responsible for checking that their delivery details are correct before completing an order.

TuliTuikku is responsible for delivering the goods in accordance with applicable consumer protection legislation.

Where TuliTuikku arranges delivery using a shipping carrier offered by us, the risk of accidental loss or damage does not transfer to the consumer merely because TuliTuikku has handed the parcel to the carrier.

If an order is delayed, lost or damaged during transportation, please contact TuliTuikku so that the matter can be investigated.

9. Right of Withdrawal, Returns and Cancellations

Consumers in the European Union and European Economic Area may have a statutory right to withdraw from an online purchase within 14 days, subject to applicable law and statutory exceptions.

Detailed information about the right of withdrawal, how to notify us of a withdrawal, return conditions, return costs and refunds is provided in our Return and Cancellation Policy.

Nothing in these Terms limits statutory rights relating to defective or non-conforming products.

10. Defective or Incorrect Products

If you receive a product that is defective, damaged, incorrect or otherwise does not conform to the contract, please contact TuliTuikku as soon as reasonably possible.

Please provide information that helps us identify and assess the issue, such as your order number and a description of the problem. Photographs may be requested where they are reasonably useful for assessing the issue.

Consumer rights concerning defective or non-conforming goods are determined by applicable consumer protection legislation and are separate from the ordinary 14-day right of withdrawal.

TuliTuikku will provide an appropriate remedy as required by applicable law.

11. Uncollected or Undeliverable Parcels

Customers are responsible for providing accurate delivery and contact information and for collecting parcels from collection points within the period specified by the shipping provider.

Failure to collect a parcel does not automatically constitute a valid notice of withdrawal or cancellation.

If a parcel is returned to TuliTuikku because it was not collected or because the customer provided incorrect delivery information, please contact us to arrange the next steps.

Any costs charged to the customer in such circumstances will only be charged where permitted by applicable law and where the customer has been appropriately informed.

12. Intellectual Property

Unless otherwise stated, the content created for the TuliTuikku online store, including TuliTuikku's original product photographs, graphics, texts, logos and other original materials, is owned by TuliTuikku or used with appropriate permission.

Content may not be reproduced, distributed, commercially exploited or otherwise used in violation of applicable intellectual property law without appropriate permission.

Normal personal and non-commercial use of the website is permitted.

Third-party trademarks, software and other materials remain the property of their respective owners.

13. Reviews and Customer Content

If the online store allows customers to submit reviews, photographs or other content, you are responsible for ensuring that the content you submit is lawful and that you have the necessary rights to submit it.

Content must not infringe another person's intellectual property, privacy or other rights and must not contain unlawful, threatening, abusive or malicious material.

TuliTuikku may moderate or remove content where reasonably necessary, including where the content violates applicable law or these Terms.

14. Acceptable Use of the Website

You may not use the TuliTuikku website:

for unlawful or fraudulent purposes;
to distribute malicious software;
to interfere with the security or operation of the website;
to attempt to gain unauthorised access to accounts or systems;
to collect personal data unlawfully;
to infringe the rights of TuliTuikku or another person; or
in any other manner prohibited by applicable law.

We may take reasonable measures to protect the website and its users from misuse.

15. Third-Party Services and Links

The online store may contain links to or integrations with services operated by third parties, including payment, shipping, social media and other service providers.

These independent third parties may have their own terms and privacy policies.

TuliTuikku is not responsible for the content or operation of independent third-party websites. However, this does not limit TuliTuikku's responsibilities relating to the sale of products to customers or any responsibility that cannot lawfully be excluded.

16. Shopify

The TuliTuikku online store is powered by Shopify.

Shopify provides the technical e-commerce platform used by TuliTuikku but is not the seller of products purchased from TuliTuikku.

Information about the processing of personal data in connection with Shopify is provided in our Privacy Policy.

17. Availability of the Website

We aim to keep the online store available and functioning correctly but cannot guarantee uninterrupted availability.

The website may occasionally be unavailable because of maintenance, technical problems, updates or circumstances outside our reasonable control.

Where an error affects an order or consumer rights, the matter will be handled in accordance with applicable law.

18. Liability

TuliTuikku is responsible for its obligations under applicable law.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law, including mandatory consumer rights and applicable product safety obligations.

TuliTuikku is not responsible for losses caused solely by circumstances outside its reasonable control where such limitation is permitted by applicable law.

Customers are responsible for using products in accordance with the safety instructions and intended use of the product.

19. Privacy

Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation, including the GDPR where applicable.

The Privacy Policy explains what personal data we process, why it is processed, how it may be shared and what rights customers have regarding their personal data.

20. Changes to These Terms

TuliTuikku may update these Terms from time to time, for example because of changes to our services, business operations or applicable law.

The version applicable to an order is generally the version that was in effect when the order was placed.

The latest revision date is displayed at the beginning of these Terms.

21. Governing Law and Consumer Rights

These Terms and contracts concluded with TuliTuikku are governed by Finnish law, without depriving consumers residing in another country of any mandatory consumer protection rights that apply to them under applicable law.

We encourage customers to contact TuliTuikku first if a dispute arises so that we can try to resolve the matter.

Consumers may also have the right to seek assistance or remedies through the competent consumer protection bodies or courts available under applicable law.
